  • The stop was invalid. The officer must have a reasonable suspicion of unlawful conduct to justify stopping you in the first place.
  • The officer’s observations are not conclusive. The officer may claim that you appeared intoxicated because of such things as slurred speech or blood-shot eyes. However, these things do not necessarily mean that you were intoxicated and there may be other reasons for some behavior.
  • Field sobriety tests may not have been administered properly or there may have been some reason other than alcohol for poor performance on the tests. The road might have been uneven or the lighting poor, or you may not have had enough sleep or have been on medication that affected your responses.
  • A breath test may not have been administered properly. The operator must be certified, there is a required observation period before the test, and the machine must be working properly.
  • A blood or urine test may not have been handled properly. Blood and urine specimens must be collected properly and then labeled and handled carefully.
